1. BIRDS, (the Agents) act only for the owners of the holiday accommodation. The contract is therefore between the Owner and the Tenant.
2. All applications for reservations must be made by our on-line booking system or by completing the form inside our brochure and accompanied by a deposit. A booking fee of £15 is also payable. A binding contract between the holidaymaker and the owner shall be entered into upon the Agent issuing it's confirmation form as Agent for the Onwer. The balance of the hiring charge will be payable 28 days before the commencement of the holiday. Bookings received within 28 days of the prospective holiday date must accompanied by the full rental charge and booking fee. Such bookings will be firstly referred to the owners before confirmation is issued by the Agents. Receipt and banking of any deposit will not constitute a confirmed booking. All payments shall be made to the Agent at the Agent's address on the Booking Form. Signing the Booking Form certifies that the applicant is over 18 years of age and confirms that the property will be used and inhabited for the purpose of a holiday - not for social gatherings, teenage holidays, etc. Agents and Owners reserve the right to refuse bookings without question. Should the Agents be informed that the property is not being used for holiday purposes, then they and the Owners reserve the right to terminate the booking forthwith and ensure that the tenants are removed from the property. Credit/debit card payments made by telephone also constitue agreement to abide by the Booking Conditions.
3. The Agents cannot be responsible for any matter outside their control, ie; damage, injury, delays, or loss in connection with your holiday arising directly from or indirectly from mechanical or electric breakdown, inclement weather, flood, fire, temporary invasion of pests or another Act of God, war, farming, or buidling activities, acts of local or central government, for nuisance caused on neighboring properties, nor for the owner withdrawing the property due to unforeseen circumstances.
4. In the event that the Agents shall be unable to arrange the holiday accommodation requested by the holidaymaker and confirmed by the Agents in the the confirmation form, the Agents shall use their best endeavours to make alternative arrangements from properties in the Norfolk Holiday Homes Brochure only. If the alternative holiday accommdation shall not be acceptable to the holidaymaker, then the Agents shall refund in full, all monies paid and neither the owner nor the Agents shall be liable for any other loses or expences howsoever caused.
5. The owner is responsible for ensuring that the property is available to the tenant for the duration of the holiday, ie; ensuring that it is in a fit and reasonable condition but the Onwer is not responsible for any defect of which he/she/the Agents were not aware. Any equipment/appliance used in the property is entirely at the tenant's risk.
